Heather Locklear charged with battery

Prosecutors have decided not to charge Heather Locklear with felony domestic violence after her dramatic arrest in Southern California two weeks ago, multiple sources told the Daily News on Monday.

One source said the “Melrose Place” actress wont face any domestic violence charges at all — only misdemeanours involving allegations she kicked and shoved sheriffs deputies responding to a call at her Thousand Oaks residence Feb. 25.

A lawyer is expected to appear on Locklears behalf at her first court hearing in Ventura County Superior Court Tuesday morning.

Locklear, 56, was booked on suspicion of felony domestic violence and three counts of misdemeanour battery on emergency personnel last month.

A Ventura County Sheriff spokesperson said she turned “combative” and resisted arrest when deputies responded to a domestic violence call from her house and found her boyfriend had sustained a visible “traumatic” injury.

According to new reports, Heather Locklear risks spending up to five years in jail following her assault arrest! In addition to that, she might be banned from owning a firearm for a decade.

“She was immediately uncooperative. She started pushing and kicking when the deputies determined probable cause for the domestic battery and they were attempting to arrest her,” Capt. Garo Kuredjian told The News.

As for her sentence behind bars, Ventura County Senior Deputy District Attorney Thomas Dunlevy told us that Heather could spend one year in jail for every one of the five counts.

The deputies did not observe any injuries on Locklear, but the “Dynasty” star claimed she was hurt and visited a hospital before her booking at Ventura County jail a little after 1 a.m. the next day, authorities said.

Police did not identify the boyfriend, but Locklear has been dating former high school sweetheart Chris Heisser, 56, for months.

She apparently had a huge argument with her fiancé Christopher Heisser last month, and she ended up attacking him.

Heisser was arrested for DUI shortly after Locklears arrest as he piloted a Mercedes southbound on the 101 Freeway in Ventura County, a California Highway Patrol spokesperson told The News.

The authorities decided to confiscate her Smith and Wesson .38 revolver but did not manage to find it in her home.

“He was driving at an unusually slow speed for that time of the evening,” CHP Officer Marco Marin said.

The actress was charged with four misdemeanor counts of battery of a police officer and one of resisting arrest.

“Mr. Heisser provided a breath sample that came back .19 per cent blood alcohol.”

Heather Locklear was set to arrive in court for the first appearance arraignment today, but she did not show up.

Heisser was arrested at 12:43 a.m. and booked for misdemeanour DUI. He was cited and released shortly after 8 a.m. with a court date set for late April.

The search warrant read that she showed erratic, aggressive behavior toward law-enforcement.

Locklears lead defence lawyer Blair Berk declined to comment when reached by The News.

The “T. J. Hooker” actress was previously arrested in 2008 on suspicion of driving under the influence. She pleaded to a lesser charge of reckless driving and was sentenced to probation.

Locklear was one of the biggest TV stars of the 1980s and early 90s and twice married famous rock musicians.

She was married to Motley Crue drummer Tommy Lee from 1986 to 1993 and Bon Jovi guitarist Richie Sambora from 1994 to 2007.

Her engagement to fellow “Melrose Place” star Jack Wagner fell apart in 2011. The couple had a post-breakup battle in December 2011 that generated a police report but no criminal charges.

Actress Heather Locklear has been temporarily banned from possessing any guns after she allegedly threatened to shoot officers responding to a report of domestic violence at her home.

A judge on Tuesday ruled the former Dynasty star, 56, could not hold any firearms as part of her bail conditions after she was charged with battering sheriffs officers.

Outside court, Ventura County Sheriffs Office spokesman Sergeant Eric Buschow said the force is looking for a handgun registered to Locklear after she was arrested in her Thousand Oaks, California, home on the night of February 25.

She said that if they (the officers) ever come back to the house that she would shoot them, he said.

Locklear, also known for appearing in Melrose Place, faces up to five years in prison if found guilty, district attorney Thomas Dunlevy said.

She was arrested on suspicion of injuring a partner but was not charged with any domestic violence offences.

Instead, she was charged with four counts of battery on a sheriffs officer and one count of obstructing an officer.

Overseeing the case at Ventura County Superior Court, commissioner Derek Malan agreed to Mr Dunlevys request to add the restriction to her bail conditions.

Defence lawyer William Haney had argued: I dont think my client has had a gun for many decades.

According to the Los Angeles Times, Mr Buschow previously described her behaviour with officers as extremely hostile and at one point she became combative.

In 2008, she pleaded guilty to reckless driving after being arrested on suspicion of the more serious charge of driving under the influence of prescription drugs.

Locklear, who was previously married to Motley Crue drummer Tommy Lee and later Bon Jovi guitarist Richie Sambora, was released on a 20,000 dollar (£14,385) bail.
